Wills & Estates

Planning for your family’s future after you are gone is an important legal task. Your Will is an extremely important document that must be carefully drafted and stored in a secure location. A badly written or damaged Will may be contested after you have passed away, and your estate may not be distributed as you had hoped.

We can draft your Will based on your instructions and provide advice where necessary about any legal issues which may arise after your death. You can either choose to take the original Will with you, or have it stored in our safe for safe keeping at no additional charge.

If you take the time now to make an effective legally binding Will and Testament you can save your family not only stress but money in what will undoubtedly be a difficult time for them.

At the same time as considering your Will we strongly recommend that you also put in place plans for any future incapacity.

Enduring Power of Attorney Documents

An Enduring Power of Attorney is a document that can be drafted to legally appoint a person or several people (your Attorneys) to make decisions for you in relation to financial and/or personal/health matters. This document can take effect immediately, on a particular date, or at a later stage in your life when you do not have the capacity to make decisions yourself.

An Enduring Power of Attorney is a document that people commonly have drafted at the same time as they draft their Wills and we offer a discount to have the Will and Enduring Power of Attorney documents drafted at the same time.

If you already have an Enduring Power of Attorney document and need the document to be registered for any reason, please call us to discuss this process and how we can assist you with this.

Costs:
Single Will: starting from $330.00
Single Enduring Power of Attorney: $165.00
Single Will and Enduring Power of Attorney: starting from $400.00
Reciprocal Wills (2 documents): starting from $440.00
Reciprocal Wills and Enduring Power of Attorney documents (4 documents): starting from $500.00
Reciprocal Wills are individual Wills drafted to ensure that an individual’s estate is left to their partner and in the event that their partner passes away prior to the individual or at the same time, these type of wills provide for the individual’s estate to be distributed to other individuals

Our costs listed are for simple Wills and Enduring Power of Attorney documents. If your matter is complex or involves complex estate assets, we reserve the right to charge additional fees. Any potential additional fees will be discussed with you prior to us drafting your documents.

Contested Estates

Have you been left out of a Will? If you feel that you were entitled to be a beneficiary in a will then you may have a right to file a claim under the Family Provision Act.

There are several legal requirements that must be met in order for a person to successfully contest a Will.

We can assist you in obtaining a copy of the Will or dealing with situations in which the deceased did not leave a Will. We can help to determine your eligibility and advise you on the evidence the Court takes into.

Consideration in Family Provision Applications.

There are important time limits involved in making a Family Provision Application and if you think that you may be eligible, we encourage you to contact our office as soon as possible in order that we may assist you.
